CONTEST DESCRIPTION: The USA TODAY BASH FOR CASH GRIDIRON BASH voting Contest ("Contest") begins on January 1, 2008 at 12:01 PM ET and ends on April 19, 2008 at 3:00 AM ET (the "Contest Period"). During the Contest Period, you are invited to vote for the university which you wish to support. Void where prohibited. Onsite university attendance will account for 70% of total points and online and text voting will account for 30% of total points. The university who compiles the most points will be named the official winner. Prizes awarded will be as follows.
1st place: $1,000,000 donation to the university's general scholarship fund.
2nd place: $500,000 donation to the university's general scholarship fund.
3rd place: $250,000 donation to the university's general scholarship fund.
Additional prizes include:
1. One participant will be randomly chosen and named "The Ultimate College Gridiron Fan." "The Ultimate College Gridiron Fan" will receive roundtrip airfare, accommodations and admission to the College Football Hall of Fame induction ceremony in Southbend, IN, where he/she will be recognized as the "Ultimate College Gridiron Fan." The total value of this prize is not to exceed $5,000..
2. One participant from each school will be named that school's "Gridiron Fan of the Year" to be randomly chosen and recognized on stage the night of the Gridiron Bash event on that school's campus.
ELIGIBILITY: You must be a legal U.S. resident physically residing within one of the fifty (50) United States or the District of Columbia and be 13 years of age or older as of the first day of the Contest Period.
TO ENTER BY CELL PHONE: If you have a text messaging capable cell phone from a participating carrier, you may enter the Contest by first sending a text message with the suggested keyword for the university you wish to support to the short code 23909 during the Contest Period you will be charged .99 on your next wireless bill. (You are not being charged to enter but being charged to submit your vote electronically you will then receive a reply verifying your vote and asking your permission to be contacted in the future. After you have opted in, you will receive a "thank you" text message from our sponsor including a confirmation that the message has been received or an error message noting delivery failure. If you get an error message, please try again. Your university will receive 1 point per text vote. Premium text messaging rates apply to all text message entries sent and received in connection with the Contest. Text messaging and wireless service are not available in all areas. Standard rates also apply.
TO ENTER FREE ONLINE: To enter, go to www.gridironbash.com, review the voting section, and complete and submit the online entry form ("Entry Form") during the Contest Period. The Entry Form will ask for your name, telephone number, email address and which university you choose to vote for. Your university will receive 1 point for each online vote.
ENTRY LIMITATIONS: Regardless of the method of entry, you are limited to one hundred (100) entries per email address/cell phone during the Contest Period. Additional entries from the same person or same email or cell phone account will be disqualified. Entries generated by a script, macro, robotic or other automated means will be disqualified. All entries become the property of the Sponsor and will not be acknowledged or returned.
By entering the Contest, you consent to the use of your name and domicile as provided by you, for purposes of advertising, promotion and publicity, all without compensation unless prohibited by law.
Entries that are incomplete or illegible are void and will not be accepted. All entries must be received before 3:00 AM ET on April 19, 2008. By participating, entrants unconditionally accept and agree to comply with and abide by these Official Rules and the decisions of Sponsor.
SELECTION OF THE WINNERS:
1. All contestants entering their vote will be entered into a random drawing for cash prize of being named "The Ultimate College Gridiron Fan." One (1) winner ("Winner") will be randomly drawn from among all eligible entries received. Winner will be notified via telephone or text message, depending on the method of entry. Winner must respond to such notification within twenty-four (24) hours after the notification is sent or an alternate winner will be drawn at random from among the remaining eligible entries. Sponsor will make two (2) attempts, during normal business hours, to notify Winner at the phone number or e-mail address provided at time of entry. If Sponsor is unable to reach the potential Winner via phone or e-mail after two (2) attempts, an alternate Winner will be selected.
2. All contestants entering the their vote on the night of the Gridiron Bash event at a particular school will be entered into a random drawing for the prize of being named that school's "Gridiron Fan of the Year." One (1) winner ("Winner") will be chosen at each participating school. Winner will be notified via mobile phone or text message. Winner must respond to such notification within fifteen (15) minutes after the notification is sent or an alternate winner will be drawn at random from among the remaining eligible entries. Sponsor will make two (2) attempts to notify Winner at the mobile phone number provided at time of entry. If Sponsor is unable to reach the potential Winner via mobile phone or text message after two (2) attempts, an alternate Winner will be selected.
All Winners will be required to complete, sign and return an Affidavit of Eligibility and Liability/Publicity Release ("Contest Documents") within one (1) business days of notification. If for any reason the potential Winner does not meet any of the eligibility requirements or does not satisfactorily execute all of the required Contest Documents, in Sponsor's sole discretion, Winner will forfeit the prize, and an alternate Winner will be selected by random drawing from among the remaining eligible entries. Decisions of the Sponsor are final and, by participating, entrants agree to be bound by these decisions.
Acceptance of any Prize constitutes permission (except where prohibited) to use Winner's name, hometown and likeness for purposes of advertising, promotion and publicity without additional compensation. Winner is solely responsible for all expenses and costs associated with acceptance and/or use of any prize including, without limitation, any and all federal, state and local taxes.
DISCLAIMER: By entering the Contest, entrants waive any right to claim any ambiguity or error in these Official Rules or the Contest itself, and agree to be bound by these Official Rules and by all decisions of the Sponsor, whose decisions are binding and final. Winner assumes all liability for any injury or damages caused or claimed to be caused by his or her participation in the Contest and/or the acceptance and/or use, miss-use or non-use of any prize, and releases Sponsor, its parent, subsidiaries, affiliates, officers, directors, and employees, ("Released Parties") from any such liability. Released Parties assume no responsibility for any injury or damage to participants as the result of participation in the Contest and/or acceptance, use, miss-use or non-use of any prize, or to any other person's computer relating to or resulting from entering or downloading materials or software in connection with this contest. Released Parties are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, for inaccurate transcription of entry information, errors in any promotional or marketing materials, errors in these rules, for any human or electronic error, or for entries that are stolen, misdirected, garbled, delayed by computer transmissions, lost, late, damaged, or postage due. Entry constitutes permission (except where prohibited by law) to use Winner's name, city, state, likeness, and voice for the purposes of advertising, promotion and publicity, in all media now known or hereafter discovered, worldwide, in perpetuity, without notice, review or approval by winner and without additional compensation. Entrants must be the registered subscriber of the cellular phone or email account from which the entry is made. Entries will be declared made by the authorized account holder of the cell phone number or e-mail address submitted at time of entry. Failure to comply with these rules may result in disqualification from this Contest. Sponsors reserve the right to withdraw the transmission of this contest or permanently disqualify from any promotion any person it believes has violated these rules. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT OF THE LAW (AND TO DISQUALIFY SUCH PERSON FROM THE CONTEST, IF APPLICABLE).
The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
GOVERNING LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of any participant, Sponsors, and/or any of the Released Parties shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules or provisions which would cause the application of the laws of any jurisdiction other than the State of New York. If any controversy or claim arising out of or relating to the Contest, the Official Rules, or the breach of any term hereof, cannot be otherwise resolved, it shall be resolved by binding arbitration conducted in the County of New York, and administered by Judicial Arbitration and Mediation Services ("JAMS") in accordance with its then current Arbitration Rules and Procedures ("the JAMS Rules"). The JAMS Rules for selection of an arbitrator shall be followed, except that the arbitrator shall be an experienced arbitrator licensed to practice law in New York. The decision of the arbitrator shall be binding, final and conclusive and shall not be appealable to any court.
